Terms of Use

Introduction
These Terms govern your use of A-Packets, an online service for uploading, processing, and analyzing packet capture files, including PCAP and PCAPNG files.
"A-Packets", "we", "us", and "our" refer to the operator of the A-Packets service. A-Packets is operated by the provider responsible for maintaining the A-Packets website and services. Legal, privacy, security, and data protection requests can be sent to admin@apackets.com.
By accessing or using the Service, creating an account, uploading a file, buying a plan or credit pack, or using an API key, you agree to these Terms. If you do not agree, do not use the Service or upload files to it.
Definitions
- "Service" means the A-Packets website, upload functionality, analysis engine, public reports, private workspaces, API, on-premise offerings, and related services.
- "Uploaded Files" means PCAP, PCAPNG, or other network capture files submitted to the Service.
- "Analysis Results" means reports, extracted metadata, protocol information, alerts, credential findings, host information, DNS records, TLS/SSL findings, files extracted from traffic, and other information generated from Uploaded Files.
- "Public Analysis" means analysis performed through the free or public upload flow, where results may be accessible through a public report page.
- "Private Analysis" means analysis performed under a paid private workspace, credit pack, API key, or other private mode, where results are not intentionally listed in the public report feed.
- "User" means an individual or organization that accesses or uses the Service.
Eligibility and Account Registration
You may use the Service only if you can form a binding agreement and are legally permitted to use the Service in your jurisdiction. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
You are responsible for maintaining the security of your account, authentication methods, API keys, and any activity that occurs under your account. Notify us immediately if you suspect unauthorized access.
Public and Private Analysis
A-Packets offers both public and private analysis modes.
Free public analysis is intended only for sanitized, non-confidential, non-production captures that are safe to expose publicly. By using the free public upload flow, you understand that the resulting report may be accessible through a public URL and may appear in public areas of the Service.
Private analysis is intended for users who need reports and uploaded files to be kept outside the public report feed. Private analysis may be available through paid subscriptions, private credit packs, API access, or on-premise deployment options.
You are responsible for choosing the appropriate mode before uploading a file.
Uploaded Files and Analysis Results
You retain ownership of files and data you upload to the Service.
By uploading a file, you grant A-Packets a limited right to store, process, parse, analyze, display, secure, and transmit the file and related Analysis Results solely for the purpose of providing, securing, maintaining, supporting, and improving the Service, subject to the selected analysis mode and our Privacy Policy.
You represent that you have the necessary rights, permissions, and authority to upload and process each file you submit to the Service.
Sensitive Captures and User Responsibility
You must not upload confidential, regulated, client, production, incident-response, or otherwise sensitive network captures through the free public analysis flow.
Network capture files may contain credentials, tokens, cookies, internal hostnames, IP addresses, DNS queries, URLs, file contents, authentication exchanges, payloads, and other sensitive information. You are responsible for reviewing and sanitizing any file before submitting it to the Service.
For sensitive captures, use a private workspace, private credit pack, API/private mode, or on-premise deployment where appropriate.
Authorized Use
You may use the Service only for files and network data that you own, control, or are authorized to analyze.
You must not upload files obtained unlawfully or in violation of another party's rights, confidentiality obligations, employment policies, customer agreements, or applicable law.
You are solely responsible for ensuring that your use of the Service is permitted by your organization, customers, clients, and applicable legal or contractual requirements.
Prohibited Use
You must not use the Service to:
- analyze traffic that you are not authorized to inspect;
- expose another person's or organization's confidential data through public uploads;
- attempt to reverse engineer, overload, disrupt, scan, attack, or bypass the Service;
- upload malware or harmful content except where reasonably necessary for legitimate defensive security analysis and permitted by the selected service mode;
- use the Service for unlawful surveillance, credential theft, unauthorized access, or other malicious activity;
- use the Service in a way that violates applicable law, sanctions, export control rules, or another party's rights.
Paid Plans, Subscriptions, Credits, and Billing
Some features require a paid subscription, private credit pack, API access, or other paid plan. Plan limits, quotas, supported file sizes, private storage features, and billing terms are shown at the time of purchase or on the pricing page.
Subscription access continues for the paid billing period unless canceled or terminated. Private credit packs are consumed according to the rules shown at purchase. Unless a plan states otherwise, one private credit covers one private analysis.
Payments may be processed by third-party payment providers. Your use of those payment services may be subject to their own terms and privacy notices.
Retention and Deletion
Retention and deletion of Uploaded Files and Analysis Results depend on the analysis mode, account status, and applicable plan.
Anonymous public uploads are handled as described in our Privacy Policy. Account-based uploads and private analysis results may be retained until deleted by the user, unless a different retention period applies for operational, legal, security, abuse-prevention, or billing reasons.
Deletion may not immediately remove data from backups, logs, payment records, security records, or other systems where retention is required for legitimate operational, legal, or security purposes.
Privacy and Data Processing
Our Privacy Policy explains how we collect, use, store, transfer, and delete personal data and Uploaded Files. By using the Service, you agree to the data practices described in the Privacy Policy.
If you use the Service for business, customer, client, employee, or incident-response data, you are responsible for determining whether additional contractual, data processing, confidentiality, or compliance terms are required before uploading that data.
Security and Availability
We use reasonable technical and organizational measures to operate and secure the Service. No online service can guarantee perfect security, continuous availability, or uninterrupted processing.
The Service may be unavailable, delayed, rate-limited, suspended, or modified because of maintenance, capacity limits, abuse prevention, security events, third-party provider issues, or other operational reasons.
Third-Party Services
The Service may rely on third-party infrastructure, storage, payment, analytics, email, authentication, or other providers. We are not responsible for third-party websites, services, or content linked from or integrated with the Service unless required by applicable law.
Intellectual Property
A-Packets and its software, website, interfaces, workflows, reports, documentation, trademarks, logos, and other materials are owned by A-Packets or its licensors and are protected by intellectual property laws.
These Terms do not grant you any right to copy, modify, reverse engineer, resell, sublicense, or create derivative works from the Service except as expressly allowed by these Terms or applicable law.
Analysis Results Are Informational
The Service provides automated packet capture analysis. Analysis Results may be incomplete, inaccurate, delayed, or may fail to detect certain issues.
A-Packets does not guarantee that the Service will identify all vulnerabilities, attacks, credential leaks, protocol anomalies, malware activity, configuration problems, data exposure, or security incidents.
You should not rely on the Service as the sole basis for security, legal, compliance, incident response, or operational decisions. Always validate important findings with appropriate tools and qualified personnel.
Disclaimers
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, A-Packets disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and security.
We do not warrant that the Service will meet your requirements, operate without interruption, process every file successfully, preserve all data, or produce complete or accurate results.
Limitation of Liability
To the fullest extent permitted by law, A-Packets and its agents, vendors, suppliers, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, goodwill, data, business interruption, security incidents, or cost of substitute services.
Where liability cannot be excluded under applicable law, liability is limited to the maximum extent permitted by that law.
Suspension and Termination
We may suspend or terminate access to the Service, accounts, uploads, reports, API keys, or other features if we believe your use violates these Terms, creates security or operational risk, exposes another party's confidential data, may be unlawful, or may harm A-Packets, users, third parties, or the Service.
You may stop using the Service at any time. Account deletion and subscription cancellation options may be available in your account settings, subject to any active plan terms and retention rules.
Governing Law and Disputes
These Terms and any dispute relating to the Service are governed by the laws of Belgium, unless mandatory consumer protection, data protection, or other mandatory laws provide otherwise.
If you use the Service as a business, professional, or organization, disputes relating to these Terms or the Service will be handled by the competent courts of Belgium, except where applicable law requires another forum.
If you use the Service as a consumer, nothing in these Terms limits any mandatory rights you may have under the laws or courts of your country of residence.
Changes to Terms
We may update these Terms from time to time. If we make material changes, we will post the updated Terms on the website and update the effective date. Continued use of the Service after the updated Terms take effect means you accept the updated Terms.
